As many individuals have undoubtedly discovered, it is not always that easy to know for sure if a situation is one that requires the assistance of an attorney. There may be times when an individual may be in desperate need legal help, but not realize it. There may also be times when it may appear that legal help is needed when it really isn't.
It might help to start out by imagining a broad spectrum of situations in which legal assistance might or might not be necessary. At one end of that spectrum, there are going to be situations that are basically routine and involve what are essentially simple legal transactions. These can often be accomplished by the use of a standardized legal form, such as a lease or a loan agreement, and are very often so simple that they normally require little or no legal help at all. In fact, most people might feel somewhat foolish even asking a lawyer to handle such a matter.
At the other end of that spectrum, are those situations, which are so complex that they should never be approached without the assistance of experienced legal counsel. In fact, with some situations, attempting to proceed without retaining legal counsel would probably risk seriously exacerbating the existing problem. Obviously, once that occurs, it generally becomes necessary to then retain an attorney to extricate the situation from the larger and more complex problem that has now developed. One could then expect the legal expenses at that point to be far higher than if an attorney had been handling the matter from the beginning.
.....AN INDIVIDUAL MAY BE IN DESPERATE NEED LEGAL HELP, BUT NOT REALIZE IT.
Within these two extremes, however, there lies a rather broad portion of that spectrum encompassing those situations in which it might be, at times, somewhat unclear whether or not legal assistance should be sought.
Without a doubt, the decision of whether or not to consult with and possibly retain an attorney can admittedly be a difficult one. But consider, on one hand, what the cost would be for a consultation with an attorney to see if the situation is one which even would necessitate an attorney's assistance. Then consider, on the other hand, the risks involved in connection with all of the possible negative repercussions and consequences of not having an attorney when one might have been necessitated. It would seem that the cost of that consultation would be far outweighed by the negative risk of not seeking that consultation.
Therefore, if confronted with a situation which you sense might require legal assistance, play it safe and consult with an attorney to at least advise you whether your situation is one that necessitates legal representation.
